Frequently Asked Questions

What is voir dire?

Voir dire is most commonly known as the legal term for the questioning of jurors to establish whether or not they will be seated on a jury.

More generally it may be used to refer to the questioning of jurors in other contexts. This is very unusual, but we do know of a case in which the judge halted proceedings in order to conduct a highly intimidating mid-trial voir dire to try and root out any jurors who might be considering exercising their right to jury nullification.

Though this generally won't be its use on the FIJA website, you may in other contexts hear the term voir dire used to refer to the questioning of witnesses to establish their credibility. For instance, an expert witness might be questioned about their training, credentials, and experience to establish their ability to provide expert testimony.
