Hung Jury

  • When an insufficient number of jurors are able to agree on a verdict, a judge may encourage them to deliberate further by issuing an Allen charge. If they remain unable to reach a verdict, eventually the judge will dismiss them without a verdict having been reached. Such a jury is known as a hung jury.
