Trial by Jury

  • Trial by jury refers to a legal trial that is decided by a jury. 

    Contrast this with a bench trial.

Trial Tax, Trial Penalty

  • The additional penalty a defendant receives when they lose in a trial by jury over the penalty offered to them had they take a plea bargain is known as the trial tax, or alternatively, the trial penalty.
