The following motion and amicus brief were prepared by attorney Nancy Lord, MD, and filed on behalf of the Fully Informed Jury Association in the case of Alaska v. Frank Turney. Turney was accused of jury tampering and related charges for his creative attempts to inform Fairbanks jurors of their power to bring in a verdict according to conscience. Although they are specific to an Alaska prosecution, these documents contain considerable legal logic and citations which should prove valuable to jury power activists similarly charged in any state or federal jurisdiction. IN THE COURT OF APPEALS FOR THE STATE OF ALASKA Motion for Leave to File Amicus Brief COMES NOW, the Fully Informed Jury Association, (FIJA) by and through its Legal Advisory Committee member, the undersigned counsel, and respectfully requests leave to file an amicus brief for the above-captioned defendant. In support of its request, FIJA shows the Court the following: 1. The Fully Informed Jury Association is a national educational and public policy organization headquartered in Helmville, Montana. 2. Members of FIJA regularly go to the sidewalks surrounding courthouses to express their views. 3. FIJA supports the activities of Frank Turney in expressing his opinion with respect to his perceptions of what rights and powers an Alaska jury has. 4. The above-captioned case may have implications in other parts of the country. 5.
