East Moline’s Labor Day Parade was a fun filled day for many folks on Monday, September the 5th. Members of a local Ron Paul meetup and the local Fully Informed Jury Association (FIJA) in Illinois teamed up together to educate the large crowds that gathered together to watch East Moline’s Labor Day parade. Although Labor Day coincided with Jury Rights Day the year, the groups believe it provided for a unique opportunity to promote the importance of jury rights in our system of government.

The Illinois Liberty Alliance entry rolled through the parade with 11 volunteers, a white Ron Paul 2012 decorated van playing Ron Paul supporting music, two FIJA banners which read, “Called for Jury Duty? Know your Rights. FIJA.ORG”, over 3,500 pieces of literature, and bags of candy and balloons. The literature included Ron Paul newspapers made by an Iowa grassroots group and Jury Rights Day cards created by the Fully Informed Jury Association (FIJA).

Nancy Brandt of Henry County was the coordinator of this event. “We spent 5 1/2 hours stamping the literature with “Illinois Liberty Alliance. Find us at: SuperLiberty.com”. We enjoyed walking with the banners, and we distributed 1600-1700 Jury Rights Day cards at East Moline, Illinois’ Labor Day Parade. One man I gave a card to said, ‘I better look at this. I’ve got jury duty coming up.’ I told him to go to the FIJA website.” Nancy expects the cards to be good advertising tools for their local group.

Rafe Thrasher, a Ron Paul supporter in Illinois said, “Ron Paul is a huge promoter and educator of jury rights, so it makes sense that we join forces with the local Fully Informed Jury Association (FIJA) and help them promote Jury Rights Day in a Labor Day parade.”

In celebration of Jury Rights Day, David and Leona Merrick and other Montana volunteers hosted a FIJA outreach table at the Ravalli County Fair. The fair, which has been held annually for more than a century, took place in Hamilton, Montana from 31 August through 3 September 2011. Drawing approximately 20,000 people, the Ravalli County Fair is the largest event in the county.

The outreach table featured FIJA outreach literature, including our brand new Fresh Air for Justice brochure, freely available for anyone to take. One of our brand new 6′ wide by 3′ high FIJA banners hung on the wall next to the table was easily visible all the way across the building. The banner was also carried in the Fair Parade kicking off the event.

Volunteers at the table were available to offer literature to passersby and to invite them to sign petitions for state initiatives, including a fully informed jury initiative. While FIJA National is a strictly educational organization that does not engage in political activities, state level groups and individuals not covered under our 501(c)3 status may do so at their discretion.

David and Leona Merrick reported that most responses to juror education outreach efforts were positive. “If they’re not in favor of jury nullification and they think that we’re kind of going against the grain, we just thank them for stopping by and for listening to our pitch. We try to give them, if they will take it, some further information on what the fully informed jury means,” David said.

“There are probably about a thousand or so, I’d guess, that we have talked to,” David estimated over the course of 4 days of outreach. He noted that they have distributed FIJA literature every year for the last few years at the fair. Several people who visited the table recognized the outreach effort from previous years.

Leona also credited FIJA’s eye-catching, yellow “We Are Everywhere” t-shirts for attracting people to the table to learn more. “I think we have passed out the most literature ever this year,” she said.

Misinformation has been circulated through the internet—by someone not affiliated with FIJA—regarding the status of Belvin Perry’s order banning distribution of FIJA literature at the Orlando and Orange County courthouse complex in Florida. We remind all activists that this order has not been removed. It is being legally challenged, but it is still enforceable until such time as a ruling is issued.

An individual, ignoring FIJA’s policy against violating any court order, was arrested yesterday, for allegedly violating the court order. The individual may have been relying on misinformation spread on the internet.

FIJA reiterates its outreach policy—clearly articulated since the order was imposed—of peaceful forbearance. As FIJA stated in February, nobody serves the interests of FIJA, human rights, justice, or free speech by violating this order, although the order clearly violates our human rights. FIJA reminds activists that inaction by government servants does not mean they will forgo enforcement of an order at another time. This is called personal discretion.

As long as Perry’s order has legal standing, it can be enforced at any time. Government servants use personal discretion in their enforcement of the laws. Police, prosecutors, and judges use personal discretion in deciding when to enforce many laws, especially statute laws. FIJA encourages all free and independent people to educate everyone about the right to individual discretion of jurors.

FIJA strongly discourages anyone from violating Perry’s order. Avoid that small spot of ground occupied by the Orlando and Orange county court complex. There are thousands of other places in Orlando and Florida to educate free people.

FIJA educates all free and independent people that they have that same right to exercise discretion that government servants exercise everyday. FIJA reminds everyone to be familiar with and follow FIJA guidelines (.pdf).

For the current status of FIJA’s challenge to this order, please visit the FIJA website. More information on FIJA’s ongoing challenge to the illegal order issued by Judge Perry:

Within a few days, FIJA will have new banners available for events such as conferences, meetings, marches, speaking engagements, conventions, and other times when you’d like to make a significant statement to the public. All of these banners are suitable for table fronts, for above tables on the walls, for draping a podium, and for affixing to two uprights for carrying.

They can be previewed online here.

FIJA will ship them, postage paid, for a deposit, and on their return when the event is over, and FIJA will refund the deposit. If you would like to purchase a banner, please contact us for details.

We also remind everyone that all of our brochures are available free online for you to download and print for your events. If you are planning to order brochures or other materials for events throughout the summer, and especially if you are planning a Jury Rights Day (5 September) event, be sure to place your order early to ensure sufficient shipping time. We recommend ordering 3 weeks in advance.

Are you planning to distribute FIJA brochures or other materials from our Media Catalog? Our Who Owns Your Body? brochure and Citizens Rule Books are particularly popular for such events. Our brand new Fresh Air for Justice brochure would also be very appropriate.

Order soon to allow for plenty of time for delivery. We recommend that you order 3 weeks in advance to allow plenty of time for packaging and shipping your order.

While we do attempt to fulfill shorter notice requests as we are able to, we are not always able to do so. If we are able to, your shipping charge may need to be adjusted upward to cover the full amount of shipping via Fedex. We generally do not ship last minute orders until we have received payment for the full shipping cost and will have to get in touch with you before shipping to give you instructions on how to do that. If you have a last minute need for materials, you may wish to print your own from our free masters available for download in our Library.

We know that some potential activists may be concerned about encounters with law enforcement while distributing FIJA literature near courthouses. Thousands of activists over the years have distributed FIJA literature near courthouses without any legal issues. We do not want FIJA activists getting arrested because it detracts from our mission which is to educate all potential jurors about their rights and responsibilities when serving on a jury.

This week’s Freedom Friday video features FreeKeene.com activists in Cheshire County, NH peacefully asserting their right to distribute FIJA literature while gracefully but assertively avoiding a legal situation.

Being jailed virtually end one’s ability to reach jurors for the duration of one’s imprisonment. Activists getting arrested have also been cited by many other potential activists as reasons they have been dissuaded from handing out literature. This is counterproductive to FIJA’s mission of educating as many potential jurors as possible. Therefore, FIJA’s policy is for activists to avoid getting arrested and instead challenge any violations of their right to distribute literature by other means.

FIJA does not provide legal advice, nor do we have resources for your legal defense should you get arrested. When we are distributing literature and are confronted by law enforcement, we do our best to defuse the situation peacefully rather than escalating the confrontation.

If told to leave the place we are handing out brochures, we may ask the officer, “Where am I allowed to stand?” If the officer will not point out a specific location, we may ask about a specific location. For example, “Do you have any objection if I stand (across the street, over there, etc.)?”

We may ask the officer “I’m willing to leave, but can you please tell me what law or statute you are enforcing because I believe it violates my First Amendment rights?” Before we leave, we may ask, “May I have your name and employee identification number? If I decide to challenge this, I may want to call you as a witness.”

For more of our observations on what has traditionally worked for our activists who distribute brochures near courthouses, we encourage you to read our flyer on Handing Out FIJA Literature Near Courthouses (pdf).

If you would like to recommend a jury-related video for Freedom Friday, let us know in the FIJA forum or by sending an e-mail to us at aji(at)fija.org/aie653l.

As we announced yesterday, a Florida judge has issued an unlawful order in violation of free speech rights in an attempt to prevent jurors from learning about their rights and responsibilities in delivering justice when serving on a jury. We ask that ALL FIJA educational outreach efforts for Florida be put on hold while we deal with this unlawful order. Instead of distributing FIJA educational outreach materials in Florida, we ask that all Florida FIJA activists, and all FIJA activists everywhere, please download and distribute the following flyer:

We Seek to Obey the Law

Note: The point of this flyer is NOT educational outreach material. This flyer does not address jurors, nor does it discuss the issue of jury nullification. Rather, this flyer is directed to Judge Belvin Perry, Jr. and challenges the legality of his administrative order. Please use this flyer for the next ten days.

We ask FIJA activists to please print, e-mail, post and otherwise distribute this flyer to media, blogs, friends and the general public. Please also send registered copies of the flyer to the judge in question. Multiple copies sent by registered mail from around Florida and elsewhere would be ideal.

The contact information for Judge Perry follows. Please conduct all communication in a civil manner. Most particularly, we encourage you to send the flyer by fax and by registered mail to Judge Perry.

Chief Judge Belvin Perry, Jr.
Suite 2110
Orange County Courthouse
425 N. Orange Avenue
Orlando, FL 32801

Tel: 407.836.2008
Fax: 407.836.2006

Our goal is always, in whatever we do, NOT to give the government the pleasure and satisfaction of arresting peaceful people. Our goal is to embarrass them by pointing out the contradictions of their own actions.

On Rushing to the Barricades …
On the matter of the reactive federal judge in Florida, and his silly order…

Dear Impatient FIJA Friends,
Bless you for your courage, for your impatience, and for your decent sense of outrage. Please think a moment about how much we might gain, and how easily we could lose that gain.

Let us visit for a moment: Yes, an unfortunate federal judge, lackey of his masters, has issued a silly bit of paper, with some order on it, which will turn this situation into a farce, at the expense of that judge. Bear with me on this for a moment.

We don’t want any more people in jail. You are each individual, thinking humans, so you make your own decisions. We are asking everyone to stay home a few days, as we coordinate a national response, as well as mount a multi-faceted challenge to this barbaric, uninformed, unethical attack on human rights. We don’t need any more arrests. That is not how you get the reaction you want from power-damaged minds—you never do quite enough so that they can arrest you.

(Think bigger: what is your GOAL?)

Reaction is not a strategy—it is playing on their level. We are above that, as thinking, peaceful humans who are less power-damaged (and many of us healing from power damage while learning more effective strategies). Getting arrested is not the solution—a challenge is a solution, and the judge has played right into our hands this time, because, you see, there was no one to arrest (thanks to James’ excellent restraint and his insistence on staying inside FIJA’s guidelines in all instances), and power is not patient with irritations, so the judge has issued an unlawful administrative order, which we can challenge directly.

We have been peaceful, we have wished to obey the laws. Now, they are changing the rules on us. They are changing the rules and threatening the use of force against peaceful, law-abiding people. So we ask: show us the law which allows this new rule. Only we will be asking more questions than one, many of them critical, and we will do all this as publicly as possible. They cannot stop the signal*. Watch what we do. Join us in the doing.
Cogito, ergo armo.

We are being peaceful in the fullest sense of the word. There are no movies of us being anything but peaceful, lawful, rational, logical, and cooperative. Even MSM cannot depict us other than kind, thoughtful, deliberate, peaceful and polite people. Watch those films on Video Jug: watch other peaceful FIJA workers discussing these concepts of human rights and independent jurors.

We don’t need people “all over it” when they do not have a long-term strategy for winning: we are about protecting human rights, not counting coup by number of arrests. We will win this one by using the Common Law and our rights—and our rational thinking—as humans. Thank goodness James stuck to the strategy and did not allow Julian or anyone else to be arrested, even when those people wanted to be arrested. Because of that strategy, this juvenile judge has grown impatient with FIJA’s standard tactics of peaceful non-confrontation, and has erroneously, subjectively, reactively, issued an easily challenged administrative order.

We will win this one, and every human rights group in this country will be with us, and some in other countries as well. No flamboyance, no defiant demonstrators, no anger, no hate—just good, solid, sound, strategy that is paying off in protection of human rights for everyone.
This bad move, on the part of those who perceive us as their enemies, gives us an opportunity to raise many questions in the minds not only of the power-damaged ones, but in the minds of those who will remember one question, and learn new ways of thinking in the answering of that question. Questions—once effectively articulated—build that box canyon of logic around those who wish to avoid such questions. Remember: Cogito, ergo armo.
Because we know you are reading this, we openly offer those who consider themselves our enemy this opportunity to examine our strategy:

STRATEGY
We plan to publicize—not based on individual personalities, but rather on the necessity for peaceful protection of our fundamental Human Rights against—unlawful actions of foolish federal feudal judges who reactively write asinine administrative orders which will soon bring public ridicule to the author of that order and to those whom he serves. We will offer to many more individual humans the knowledge that this necessary peaceful protection is available from every juror in the land. More will hear and learn. That is our strategy. We thank you for this opportunity for educational publicity at your expense. End

We carry on. Peacefully.
WE HAVE MADE A DIFFERENCE. THOUSANDS OF PEOPLE WHO NEVER HEARD THE TERM JURY NULLIFICATION, OR UNDERSTOOD THEIR RIGHTS CONFERRED BY THIS DOCTRINE, ARE NOW AWARE, AND ABLE TO EXERT THEIR RIGHTS FOR WHICH SO MANY HAVE GIVEN SO MUCH.

A front page article that appeared in Sunday’s Ocala Star Banner featured the work which Sovereignty Action has done in the distribution of fliers to prospective jurors.

We plan to continue distributing the fliers at the courthouse from 7:30 – 8:30 AM. Normally this is done on Monday mornings, but since the courthouse is closed tomorrow, we will distribute the fliers on TUESDAY.

Many people will read this article. However, some people only read the sports section. THEREFORE, I ENCOURAGE YOU TO FURTHER BUILD ON THE IMPETUS WHICH THIS ARTICLE HAS GIVEN THIS ISSUE, AND CALL RADIO
TALK SHOWS.

HERE ARE SOME TALKING POINTS, AND IF YOU WANT FURTHER INFORMATION GO TO WWW.fija.org/aie653l

TALKING POINTS FOR CALL IN TALK SHOWS ON JURY NULLIFICATION:
When you call in don’t bother with saying, How are you etc. Get to the point by saying something like this:

“It concerns me that we are losing many of our liberties and many people are ignorant of our basic rights. This is particularly true when it comes to Jury Nullification which is a major protector of our liberty. Jury Nullification is the right of a juror to determine not only the guilt or the innocence of a person, but also the duty, the right and the responsibility of a juror to determine whether or not the law which they are accused of breaking is a just and a Constitutional law.

Let me explain: An example is; If a defendant is charged with breaking a law, let’s say he’s charged with carrying a weapon which is his right under the 2nd Amendment of the Constitution. He might be guilty of breaking the law, but since the law itself is unconstitutional a juror should vote him innocent since the law is a bad law and is unconstitutional.”

IF THE TALK SHOW HOST DISAGREES, STATE:
WELL THEN YOU DISAGREE WITH Supreme Court Justice John Jay who has stated that “Juries have the right to take upon themselves to judge both the law as well the facts.” Or Thomas Jefferson who said, “I consider trial by jury as the only anchor by which Government can be held to the principles of the Constitution.” and you disagree with the rest of the Founding Fathers. I respectfully suggest that you learn more about this issue.
Unfortunately few people are familiar with this doctrine.

The following flier, news release, letter to editor, talking points and information on how to deal with resistance gives everything you need to make a significant impact for freedom. Moreover, it only takes one hour/week of your time, very little energy or money to be successful.

Take one lunch break a week for liberty. Get your exercise by taking a walk around the neighborhood on your lunch break, and help protect your rights at the same time. Is your workplace near a state or federal courthouse? That’s even better! Just take a handful of pamphlets with you and share them with those you pass along your route.

You can download brochures from our Library or order them from our Media Catalog. These brochures are great ways to help your neighbors learn about their rights and responsibilities when serving as a juror:

Who Owns Your Body? (pdf)

Jury Protection for the Second Amendment (pdf)

Your Jury Rights: True or False? (pdf)

A Primer for Prospective Jurors (pdf)

You may also want to review our flyer on Distributing FIJA Literature in Front of Courthouses (PDF) and Professor James Duane’s video Don’t Talk to the Police . Your vote as a juror is your most significant and influential vote.

When you serve as a juror, your vote is one of only twelve and is meaningful in protecting another person and yourself as well from government abuse of human rights.

We have a lot of work to do getting the word out, and we can use a lot of assistance with helping to protect your freedoms through informed jurors. If you have some time to hand out literature, to speak to groups, to write letters, to do interviews, or to help others with these efforts, please contact us! Your support and actions are most welcome!

Have questions? Get in touch your present state contacts, or the FIJA National office. Act for freedom today!

Hi,
I didn’t see this listed on the FIJA website, so thought I’d mention it so you can add it to the “Volunteer Activists Needed Now” section.

The Cannabis Action Network is organizing distribution of jury rights fliers every weekday morning in February outside the federal building and courthouse in San Francisco (450 Golden Gate Avenue at Larkin), from 7 or 730 a.m. to at least 10 a.m. We can always use more help so come on out if you can make it!
For more info, contact
Danielle Schumacher at (510) 486-8083.

C.A.N. has also produced a very nice 4″ x 6″ glossy flier on jury rights, that refers people to the FIJA website. You might want to contact them for the file so you can put it up on the FIJA site for people to check out and/or download (I just checked the C.A.N. site and couldn’t find it there, but hopefully they will also make it available online).
