Cop Block & Fully Informed Jury Association Billboards Going Up in Richmond!

On January 18th, 2012, two billboards with ads promoting police accountability and Jury Nullification will be displayed in the Richmond area. The initiative is being headed by Nathan Cox, an Army Veteran and activist for the cause of Liberty, during the week of MLK’s birthday.

It was King who stated: “One may well ask How can you advocate breaking some laws and obeying others? The answer lies in the fact that there are two types of laws: just and unjust. I would be the first to advocate obeying just laws. One has not only a legal but moral responsibility to obey just laws. Conversely, one has a moral responsibility to disobey unjust laws.”

Dr. King understood well that just because one be in a position of power, doesn’t mean that person will act in a moral way. Two organizations that advocate justice and liberty are being promoted by Nathan Cox, who believes that people have the right to be treated fairly and equally by all, whether you wear a badge or a robe.

The second organization Mr. Cox would like to promote is FIJA (fija.org), or the Fully Informed Jury Association. FIJA is a non profit organization whose goal it is to inform citizens of their rights as a juror and that the juror’s mission should be to “protect fellow citizens from tyrannical abuses of power of government.” It has become the belief that the juror’s sole duty is to help decide the innocence or guilt of a fellow citizen as well as pass down punishment upon them. Jury nullification is one right of a juror that FIJA teaches about. The founders thought it was important for the people to have a counter to bad laws and practices, so made it possible for a jury to acquit defendants who are technically guilty. An example of how jury nullification works is during the time of slavery. Some jurors would refuse to convict people who were supposedly guilty of helping to free a slave. Slavery is immoral and therefore the people felt they needed to use jury nullification to work toward justice for slaves and those who helped them.

Misinformation has been circulated through the internet—by someone not affiliated with FIJA—regarding the status of Belvin Perry’s order banning distribution of FIJA literature at the Orlando and Orange County courthouse complex in Florida. We remind all activists that this order has not been removed. It is being legally challenged, but it is still enforceable until such time as a ruling is issued.

An individual, ignoring FIJA’s policy against violating any court order, was arrested yesterday, for allegedly violating the court order. The individual may have been relying on misinformation spread on the internet.

FIJA reiterates its outreach policy—clearly articulated since the order was imposed—of peaceful forbearance. As FIJA stated in February, nobody serves the interests of FIJA, human rights, justice, or free speech by violating this order, although the order clearly violates our human rights. FIJA reminds activists that inaction by government servants does not mean they will forgo enforcement of an order at another time. This is called personal discretion.

As long as Perry’s order has legal standing, it can be enforced at any time. Government servants use personal discretion in their enforcement of the laws. Police, prosecutors, and judges use personal discretion in deciding when to enforce many laws, especially statute laws. FIJA encourages all free and independent people to educate everyone about the right to individual discretion of jurors.

FIJA strongly discourages anyone from violating Perry’s order. Avoid that small spot of ground occupied by the Orlando and Orange county court complex. There are thousands of other places in Orlando and Florida to educate free people.

FIJA educates all free and independent people that they have that same right to exercise discretion that government servants exercise everyday. FIJA reminds everyone to be familiar with and follow FIJA guidelines (.pdf).

For the current status of FIJA’s challenge to this order, please visit the FIJA website. More information on FIJA’s ongoing challenge to the illegal order issued by Judge Perry:

On Thursday, 3 February 2011, FIJA sent on FIJA letterhead via United States Postal Service certified mail, the following questions to Florida Judge Blevin Perry, Jr., to Florida Governor Rick Scott, and to Attorney General Pam Bondi:Questions for Florida Chief Judge Belvin Perry, Jr., Governor Rick Scott, and Attorney General Pam Bondi (pdf)

The letter, in part, points out this contradiction:

On 31 January, 2011, Chief Judge Belvin Perry, Jr. has issued an “Administrative Order”, barring peaceful people from engaging in their lawful freedom of speech to peacefully distribute pamphlets, on public property, related to the laws, rights and authority of jurors.

On 8 February 2010, Florida Judge David B. Eddy issued a memorandum stating, “Based on principles of free speech, I believe that whoever is distributing the handouts (referencing FIJA literature) in question has a right to do so. Accordingly, I see no reason why the handouts must be excluded from the jury assembly room. I believe we may trust jurors to follow the law as instructed by the judge.”

A contradiction in the application of the law is evident. Americans seeking to lawfully exercise their lawful rights are subject to being arrested and denied their rights by Chief Judge Belvin Perry, Jr.’s order.

Because a contradiction of the law is evident, and a damage is threatened by the power of office of Chief Judge Belvin Perry, Jr. we respectfully insist that Chief Judge Belvin Perry, Jr. and the courts and government of Florida, under penalty of fraud and other laws, certify which involved law prevails, not contradicted by any superior law: Chief Judge Belvin Perry, Jr.’s Administrative Order; or the right of the People to freely express their views in regard to this matter.

The orders in question were included in all of the mailings for reference. They can be found online as follows:
-Judge Belvin Perry, Jr.’s Administrative Order of 31 January 2011 (pdf)
-Judge David B. Eddy’s Memorandum of 8 February 2010 (pdf)

Obviously the two documents are in conflict and cannot both be valid. We believe Judge Perry’s order is clearly unlawful and in violation of freedom of speech.

We ask FIJA activists to please distribute this flyer in printed or electronic format to media, blogs, friends and the general public. Please also send certified/registered copies to the judge (click through for his contact information). We will keep you posted as to when we receive signature confirmation back on the letter and enclosures we sent to Judge Perry, Governor Scott, and Attorney General Bondi. Begin today circulating this letter, along with the flyer, to everyone.

Let’s make sure we are heard loud and clear on this one! And remember that our goal is always, in whatever we do, NOT to give the government the pleasure and satisfaction of arresting peaceful people by playing by their rules. Our goal is to embarrass them by pointing out the contradictions of their own actions.

As we announced yesterday, a Florida judge has issued an unlawful order in violation of free speech rights in an attempt to prevent jurors from learning about their rights and responsibilities in delivering justice when serving on a jury. We ask that ALL FIJA educational outreach efforts for Florida be put on hold while we deal with this unlawful order. Instead of distributing FIJA educational outreach materials in Florida, we ask that all Florida FIJA activists, and all FIJA activists everywhere, please download and distribute the following flyer:

We Seek to Obey the Law

Note: The point of this flyer is NOT educational outreach material. This flyer does not address jurors, nor does it discuss the issue of jury nullification. Rather, this flyer is directed to Judge Belvin Perry, Jr. and challenges the legality of his administrative order. Please use this flyer for the next ten days.

We ask FIJA activists to please print, e-mail, post and otherwise distribute this flyer to media, blogs, friends and the general public. Please also send registered copies of the flyer to the judge in question. Multiple copies sent by registered mail from around Florida and elsewhere would be ideal.

The contact information for Judge Perry follows. Please conduct all communication in a civil manner. Most particularly, we encourage you to send the flyer by fax and by registered mail to Judge Perry.

On Rushing to the Barricades …
On the matter of the reactive federal judge in Florida, and his silly order…

Dear Impatient FIJA Friends,
Bless you for your courage, for your impatience, and for your decent sense of outrage. Please think a moment about how much we might gain, and how easily we could lose that gain.

Let us visit for a moment: Yes, an unfortunate federal judge, lackey of his masters, has issued a silly bit of paper, with some order on it, which will turn this situation into a farce, at the expense of that judge. Bear with me on this for a moment.

We don’t want any more people in jail. You are each individual, thinking humans, so you make your own decisions. We are asking everyone to stay home a few days, as we coordinate a national response, as well as mount a multi-faceted challenge to this barbaric, uninformed, unethical attack on human rights. We don’t need any more arrests. That is not how you get the reaction you want from power-damaged minds—you never do quite enough so that they can arrest you.

(Think bigger: what is your GOAL?)

Reaction is not a strategy—it is playing on their level. We are above that, as thinking, peaceful humans who are less power-damaged (and many of us healing from power damage while learning more effective strategies). Getting arrested is not the solution—a challenge is a solution, and the judge has played right into our hands this time, because, you see, there was no one to arrest (thanks to James’ excellent restraint and his insistence on staying inside FIJA’s guidelines in all instances), and power is not patient with irritations, so the judge has issued an unlawful administrative order, which we can challenge directly.

We have been peaceful, we have wished to obey the laws. Now, they are changing the rules on us. They are changing the rules and threatening the use of force against peaceful, law-abiding people. So we ask: show us the law which allows this new rule. Only we will be asking more questions than one, many of them critical, and we will do all this as publicly as possible. They cannot stop the signal*. Watch what we do. Join us in the doing.
Cogito, ergo armo.

We are being peaceful in the fullest sense of the word. There are no movies of us being anything but peaceful, lawful, rational, logical, and cooperative. Even MSM cannot depict us other than kind, thoughtful, deliberate, peaceful and polite people. Watch those films on Video Jug: watch other peaceful FIJA workers discussing these concepts of human rights and independent jurors.

We don’t need people “all over it” when they do not have a long-term strategy for winning: we are about protecting human rights, not counting coup by number of arrests. We will win this one by using the Common Law and our rights—and our rational thinking—as humans. Thank goodness James stuck to the strategy and did not allow Julian or anyone else to be arrested, even when those people wanted to be arrested. Because of that strategy, this juvenile judge has grown impatient with FIJA’s standard tactics of peaceful non-confrontation, and has erroneously, subjectively, reactively, issued an easily challenged administrative order.

We will win this one, and every human rights group in this country will be with us, and some in other countries as well. No flamboyance, no defiant demonstrators, no anger, no hate—just good, solid, sound, strategy that is paying off in protection of human rights for everyone.
This bad move, on the part of those who perceive us as their enemies, gives us an opportunity to raise many questions in the minds not only of the power-damaged ones, but in the minds of those who will remember one question, and learn new ways of thinking in the answering of that question. Questions—once effectively articulated—build that box canyon of logic around those who wish to avoid such questions. Remember: Cogito, ergo armo.
Because we know you are reading this, we openly offer those who consider themselves our enemy this opportunity to examine our strategy:

STRATEGY
We plan to publicize—not based on individual personalities, but rather on the necessity for peaceful protection of our fundamental Human Rights against—unlawful actions of foolish federal feudal judges who reactively write asinine administrative orders which will soon bring public ridicule to the author of that order and to those whom he serves. We will offer to many more individual humans the knowledge that this necessary peaceful protection is available from every juror in the land. More will hear and learn. That is our strategy. We thank you for this opportunity for educational publicity at your expense. End

We carry on. Peacefully.

Very late last night, the FIJA office got word that our ongoing educational outreach campaign in Florida has gotten a judge’s attention. From James Cox:

Hello Ilo, On my way to talk to the students at USF today, I received a phone call from Anthony Colarossi, Senior Reporter at the Orlando Sentinel. Mr. Colarossi started asking me questions about the recent administrative order, (which is attached) made by Chief Judge Belvin Perry, Jr. on Monday, January 31, 2011. I explained that I did not know about this order, but obviously the educational materials that are handed out have struck a nerve with the judicial system.

The order (click here for the full document in pdf format) states among other things:

NOW THEREFORE, I, Belvin Perry, Jr., in order to facilitate the efficient administration of justice, pursuant to the authority vested in me as Chief Judge of the Ninth Judicial Circuit of Florida under Florida Rule of Judicial Administration 2.215, hereby order the following, effective immediately, and to continue until further order:
1. The dissemination of all leaflets and other materials to summoned jurors containing written or pictorial information tending to influence summoned jurors, as well as approaching a summoned juror for the purpose of displaying a sign to, or engaging in oral protest, education or counseling with information tending to influence summoned jurors on any matter, question, cause, or proceeding which may be pending, or which may by law be brought, before him or her as such juror, shall be prohibited on the Orange County Courthouse complex grounds.
The term “courthouse complex” and any restrictions on expressive conduct contained herein shall apply to the Orange County Courthouse complex grounds, which includes the adjacent courthouse parking garage, the courthouse courtyard, and all other grounds surrounding the courthouse, from the intersection of Orange Avenue and Livingston Street, to the intersection of Livingston Street and Magnolia Avenue, to the intersection of Magnolia Avenue and Amelia Street, to the intersection of Amelia Street and Orange Avenue, to the intersection of Orange Avenue and Livingston Street. The public sidewalks that comprise the boundaries of this designated perimeter are excluded from this designation of the courthouse complex grounds.
2. The dissemination of all leaflets and other materials to summoned jurors containing written or pictorial information tending to influence summoned jurors, as well as approaching a summoned juror for the purpose of displaying a sign to, or engaging in oral protest, education or counseling with information tending to influence summoned jurors on any matter, question, cause, or proceeding which may be pending, or which may by law be brought, before him or her as such juror, shall be prohibited on the Osceola County Courthouse complex grounds.
The term “courthouse complex” and any restrictions on expressive conduct contained herein shall apply to the Osceola County Courthouse complex grounds, which includes the adjacent courthouse parking lot, the courthouse courtyard, and all other grounds surrounding the courthouse, from the intersection of Bryan Street and Rose Avenue, to the intersection of Rose Avenue and Patrick Street, to the intersection of Patrick Street and Bryan Street, to the intersection of Bryan Street and Rose Avenue. The public sidewalks that comprise the boundaries of this designated perimeter are excluded from this designation of the courthouse complex grounds.
3. Regardless of whether the conduct at issue occurs on the courthouse complex grounds, any person who influences the judgment or decision of any grand or petit juror on any matter, question, cause, or proceeding which may be pending, or which may by law be brought, before him or her as such juror, with intent to obstruct the administration of justice, may be in violation of section 918.12, Florida Statutes.
4. Anyone engaging in the type of expressive conduct as contemplated by this Order may be in violation of section 918.12, Florida Statutes, and/or may be found in contempt of court.

This appears to be an intimidation tactic by a bully issued under color of law to circumvent the First, Fifth, and Seventh Amendments to the United States Constitution. While it may be more convenient for the court to have a jury that is easily steered by orders from the bench and selective filtering of the information it is permitted access to, it is NOT the purpose of a jury merely to rubber stamp the decision it is led to by the government. Were this the case, a jury would not be needed at all.

Rather, it is the primary function of the independent juror to protect his or her fellow citizens- both the defendant and the rest of us who will be affected by the outcome of the case and the legal precedent it will set- from abuse by government. As the only people (aside from the defendant) involved in the court proceedings who are not making a living by perpetuating the system as dictated by government officials, jurors have not only a right, but a responsibility, to act independently- to think for themselves, to consult their consciences in deliberations, to judging the fairness and applicability of the law as well as the facts of the case , and to deliver justice when rendering a verdict.

FIJA is an educational organization that seeks to inform jurors of their right and responsibility to deliver justice in all cases where they sit in judgment of another human being. FIJA does not seek to influence jurors in any particular case. Our campaign in Florida, as everywhere else, has been a general educational outreach effort to ALL potential jurors including distributing brochures near courthouses and on college campuses, speaking with community groups around the state, and so on to reach all members of the community. FIJA Director Iloilo Jones invites the judge to review any and all of the FIJA literature (available in our Library) and to point out any instance of such influence or of undue disregard for the functions of the court.

Although we just received word of this late last night, FIJA staff has been hard at work this morning:
1. Roger Roots, a member of our Advisory Board, is reviewing the document and our legal options for challenging this unlawful order.
2. We have begun fundraising efforts to support a legal challenge to the order. If you would like to contribute to FIJA’s efforts, information on making a contribution via our website, my telephone, or by mail is located here.
3. We are asking ALL FIJA activists in Florida to suspend ALL educational activity in the immediate vicinity of the courthouse which this order covers, until this administrative order, which is a heinous, unlawful, corrupt violation of human rights, can be challenged and set aside.
4. Instead, we are requesting that all FIJA activists, in Florida and elsewhere, distribute the brochure located here. Note: The point of this flyer is NOT educational outreach material. This flyer does not address jurors, nor does it discuss the issue of jury nullification. Rather, this flyer is directed to Judge Belvin Perry, Jr. and challenges the legality of his administrative order. We also ask that everyone, everywhere continue to distribute all other FIJA literature, except near the courthouse which is under this draconian order.

Our goal is always, in whatever we do, NOT to give the government the pleasure and satisfaction of arresting peaceful people. Our goal is to embarrass them by pointing out the contradictions of their own actions.

As they transpire, we will post further developments in our efforts to get this draconian order rescinded. If you would like to discuss this situation, we invite you to join us on our Discussion Forum.

A funny thing happened on the way to a trial in Missoula County District Court last week.

Jurors – well, potential jurors – staged a revolt.

They took the law into their own hands, as it were, and made it clear they weren’t about to convict anybody for having a couple of buds of marijuana. Never mind that the defendant in question also faced a felony charge of criminal distribution of dangerous drugs.

The tiny amount of marijuana police found while searching Touray Cornell’s home on April 23 became a huge issue for some members of the jury panel.

No, they said, one after the other. No way would they convict somebody for having a 16th of an ounce.

WANTED ALIVE !!
FIJA Activists Wanted for Julian Assange and Wikileaks
The Grand Jury and the Petit Jury Educational Campaign

At FIJA, the staff members believe that the more transparent we make government and government actions, the closer we come to a government of the people. Therefore, we encourage the complete transparency of all government documents, especially those related to undeclared wars against any people.

Anyone reading this who is in or near Alexandria, Virginia, please print out FIJA’s On The Grand Jury flyer (it will open as a PDF file, and that can take a minute to load), found on FIJA’s website, and get it into the hands of as many people as you can. One of the people you reach may be able to share some of the information with one of the people on the Grand Jury. It is also essential that we reach everyone who will be in the jury pool for the petit jury trial, if there is the opportunity for Julian to have one. In any event, there is nothing to lose by educating more people, and everything to gain for us all.

FIJA activists are working on identifying a vicinage for any potential trial involving Julian Assange in order to conduct general educational outreach to the entire community. We encourage all FIJA activists to coordinate efforts in FIJA’s State News and Activists Discussion Forum. It looks like a possible trial location could be the federal court in Alexandria, VA. The grand jury is apparently empaneled: http://www.cnn.com/2010/CRIME/12/13/wikileaks.investigation/index.html .

Anyone can distribute FIJA’s educational literature! Do it now! FIJA encourages all human rights activists to conduct educational outreach in a non-confrontational manner. You are encouraged to read FIJA’s brochure on Handing Out FIJA Literature Around Courthouses (pdf) for information on conducting effective educational outreach efforts.

From James Cox:

Today I met with Julian Heicklan to start his FIJA activism tour in Florida.

The weather here in Florida today was cold, but the sun was out, with a clear blue sky.

I picked Julian up at his hotel in Orlando and took him to the County Courthouse at 425 N Orange Ave, Orlando, Florida.
We were met by Mark Schmidter, T J Lawrence, John Kurtz, Marla Buchwald, Pete (new addition), Josh Parrish and Scott Olver. Later we were joined by Alle Shane. A great turnout from the Orlando group.

We split up and had every corner of the courthouse covered. Nearly everyone walking in or out of the courthouse had a yellow FIJA brochure in their hand.

Today was a great day for FIJA activism. Eight FIJA Activists came out in the cold weather to distribute approximately 1,100 brochures. Well done Team Orlando!

by Iloilo Marguerite Jones, Executive Director
Fully Informed Jury Association – fija.org/aie653l

In Wood’s new and excellent book on Nullification, much is written about the use of nullification at the state level of government against the federal level of government, but less attention is given nullification by the individual juror. Yet, the essence of justice is that human rights and conscience exist and can be exercised only at an individual level. There is no “collective right” just as there is no “collective conscience.”

While the perceived collective political community may embark on collective political posturing for myriad reasons, it is only at the individual level that the elegance of the independent juror, capable of raising a standard of justice in anticipation of the coming tides in the affairs of men, that we observe the prescient nature of the individual human conscience in steering the ship of state through troubled waters.

Throughout human history, we have moved from slavery toward the recognition of the unique rights and self-ownership of each individual human. With this journey has come the recognition of the evils of collectivist thinking at all levels of consideration. When we finally accept––as a cultural necessity––the inherent value and rights of each individual human, and when there are free markets and voluntary associations, we will still have need of juries to consider, to weigh, and to decide, what is justice and what is not.

In fact, one can readily thumb through history and find instances of brilliant juror nullification: cases in which the jurors anticipated later-recognized human rights; cases in which jurors raised the standard of justice to new heights. A recent review carefully points up shifting sentiment toward nullification. At almost every instance within this excellent article, one could substitute the concept of the individual juror for the concept of the collective state government, and in that substitution, find the essence of the concept of the jury of 12 jurors: of self-determination on an individual level, as each juror accepts the authority to judge the law as well as the fact, based on individual sense of conscience, justice, and compassion.

Investigation of instances of failure of the jury reveal that such instances can be attributed more to government employees’ political jury stacking than to jury malfunction. In many instances, racism, sexism, or other factors kept juries from being truly representative of all those connected to the case.

(The economic implications are clear: re-open justice to the vote of the free market: let the people, as should be represented by the jury in every criminal case, determine those laws considered economically viable for enforcement. We might soon see only one law: no initiation of force or fraud for any reason whatsoever.)

Let the jurors act on individual motivation, and let bad laws fall before the conscientious, informed jurors who understand that they have the authority to judge the law as well as the facts, and that it must be their personal sense of justice which compels their individual verdict. Let there be no distinction of the right to nullify bad laws, whether at the state level or at the individual level, where one juror, acting independently in good conscience, has the same right to nullify as any government body.

The jury is one of the smallest, and therefore most significant, of duly constituted bodies involved in the application of laws and the mechanisms of justice. The elegance of 12 jurors has been examined from a mathematical perspective, found as Appendix I in Vin Suprynowicz’s brilliant Send in the Waco Killers, which I imagine you have all read. Read the Appendix I again. You will be enlightened about the role of the individual juror in serving as an essential and mathematically significant check on government employees’ tyranny and attempted usurpation of human rights.

“I consider trial by jury as the only anchor ever yet imagined by man, by which a government can be held to the principles of its constitution,” a Virginia lawyer wrote … His name was Thomas Jefferson.

Jefferson clearly understood that while self-serving government employees at every level would exceed their authority given any opportunity, they could be denied that opportunity by the people who would comprise the jury, who would refuse to enforce usurpations of individual human rights. Jefferson also understood the “anchor” metaphor, and chose it above the “cannon” metaphor, because the jury is a peaceful, necessary restraint to keep the ship of state steady and safe in serving its purpose: the protection of individual human rights. Jurors hold the authority and the ability to enforce the limits of the Constitution by refusing to enforce government employees’ attempts to violate Constitutional boundaries.

Find out more by visiting the Fully Informed Jury Association. You will want to stay for a bit and read up on one of the least-known rights in our Common Law country. It is a right, that when known, effectively can save us––through peaceful means––from the war the government has declared and is making against its own people, not so different from those wars against the people that inspired the Magna Carta.

It is the independent, secular, non-partisan juror who stands as the Fourth Branch of Government, capable of placing a veto on bad laws by refusing to enforce them at the behest of self-interested government employees, whether at the federal, state, or local level. After all, conscientious nullification resides, in the final analysis, in the independent mind of the thinking individual.

Recently, he and other activists trying to hand out pamphlets published by the Fully Informed Jury Association were confronted by U.S. marshals in Manhattan. Attempting to record the encounter, Donnelly found himself being pushed to the pavement by the marshals. Then arrested. He is accused of “assaulting a federal marshal.” Another FIJA activist on the scene, Julian Heicklin, was also arrested.

Excerpt:

“Single acts of tyranny may be ascribed to the accidental opinion of a day; but a series of oppressions, begun at a distinguished period, and pursued unalterably thro’ every change of ministers, too plainly prove a deliberate, systematical plan of reducing us to slavery.”

~ Thomas Jefferson, 1774

For at least 40 years, modern proponents minarchy and anarchy have argued that we can eliminate many, if not all government functions and replace them with self-governance. Some do this by appealing to the imagination of their audiences. Robert Heinlein was particularly good at this. Some have chronicled current and past attacks on liberty to which government inevitably turns.

WE HAVE MADE A DIFFERENCE. THOUSANDS OF PEOPLE WHO NEVER HEARD THE TERM JURY NULLIFICATION, OR UNDERSTOOD THEIR RIGHTS CONFERRED BY THIS DOCTRINE, ARE NOW AWARE, AND ABLE TO EXERT THEIR RIGHTS FOR WHICH SO MANY HAVE GIVEN SO MUCH.

A front page article that appeared in Sunday’s Ocala Star Banner featured the work which Sovereignty Action has done in the distribution of fliers to prospective jurors.

We plan to continue distributing the fliers at the courthouse from 7:30 – 8:30 AM. Normally this is done on Monday mornings, but since the courthouse is closed tomorrow, we will distribute the fliers on TUESDAY.

Many people will read this article. However, some people only read the sports section. THEREFORE, I ENCOURAGE YOU TO FURTHER BUILD ON THE IMPETUS WHICH THIS ARTICLE HAS GIVEN THIS ISSUE, AND CALL RADIO
TALK SHOWS.

HERE ARE SOME TALKING POINTS, AND IF YOU WANT FURTHER INFORMATION GO TO WWW.fija.org/aie653l

TALKING POINTS FOR CALL IN TALK SHOWS ON JURY NULLIFICATION:
When you call in don’t bother with saying, How are you etc. Get to the point by saying something like this:

“It concerns me that we are losing many of our liberties and many people are ignorant of our basic rights. This is particularly true when it comes to Jury Nullification which is a major protector of our liberty. Jury Nullification is the right of a juror to determine not only the guilt or the innocence of a person, but also the duty, the right and the responsibility of a juror to determine whether or not the law which they are accused of breaking is a just and a Constitutional law.

Let me explain: An example is; If a defendant is charged with breaking a law, let’s say he’s charged with carrying a weapon which is his right under the 2nd Amendment of the Constitution. He might be guilty of breaking the law, but since the law itself is unconstitutional a juror should vote him innocent since the law is a bad law and is unconstitutional.”

IF THE TALK SHOW HOST DISAGREES, STATE:
WELL THEN YOU DISAGREE WITH Supreme Court Justice John Jay who has stated that “Juries have the right to take upon themselves to judge both the law as well the facts.” Or Thomas Jefferson who said, “I consider trial by jury as the only anchor by which Government can be held to the principles of the Constitution.” and you disagree with the rest of the Founding Fathers. I respectfully suggest that you learn more about this issue.
